Power of Attorney in Dubai and UAE

Types of Special Powers of Attorney in Dubai and UAE (Personal)
Property POA

Property Dispute POA
In the event of a property-related disagreement, you can choose another person—the attorney—to represent you by signing a Property disagreement POA in Dubai and the United Arab Emirates. Vehicle POA

Marriage POA

Court Case POA

Process of Notarizing Power of Attorney in UAE
The following easy procedures can be used to notarize a power of attorney in Dubai and other UAE Emirates:
1. Preparation of draft
First, a draft power of attorney is created, taking into account the particular needs of the principle, the person drafting the power of attorney.
2. Arabic translation
As mandated by the UAE Notary Public, the POA draft must be translated into Arabic by a legal translator who holds a valid license from the Ministry of Justice in the United Arab Emirates.
3. Notarization
There are two (2) methods of notarizing a POA in the UAE.
Physical (In-person) Notarization
In the United Arab Emirates, powers of attorney are executed and recorded with a Notary Public. It normally takes the principle 20 to 30 minutes to complete the registration process, which requires them to visit the closest Notary Public in the appropriate Emirate.
E-Notarization
POAs are registered by the Notary Public via video conference in certain Emirates, like Abu Dhabi and Dubai. The Power of Attorney can be e-notarized by courts in Dubai or Abu Dhabi, but it will be recognized throughout the United Arab Emirates.
Process of Signing/Notarizing Power of Attorney outside UAE
The principal may sign a power of attorney that must be used within the United Arab Emirates while they are not in the country. For such a power of attorney to be enforceable in the United Arab Emirates, the following procedure must be completed after the draft has been prepared. It should be mentioned that this procedure can be used for complicated powers of attorney that include several tiers of shareholders. For others, we would suggest using the previously described e-notarization procedure.
1. Signing/Notarizing before Notary Public
The power of attorney must first be signed and notarized in front of a Notary Public in the principal’s home nation.
2. Legalization
The principal must attest the paper at the ministry of foreign affairs of his own country following notarization. A different government department may carry out the functions of the minister of international affairs, depending on the jurisdiction. This procedure is known as apostille or legalizing.
3. Attestation by the UAE Embassy
The UAE Embassy or Consulate must stamp the document as the final step in the legalization procedure in the country of origin. The paper is then delivered to the United Arab Emirates to finish the legalization procedure.
4. Attestation by the UAE Ministry of Foreign Affairs
The UAE Ministry of Foreign Affairs must stamp the document after it is received in the country.
5. Attestation by the UAE Ministry of Justice
The POA is stamped by the UAE Ministry of Justice as the final step in the legalization process, certifying that an authorized translator completed the Arabic translation. Should the translation of the POA be completed subsequent to the attestation by the UAE Ministry of Foreign Affairs, it must be completed on the translator’s letterhead and bear their stamp. The translation and the original POA need to be stapled together.
E-Notarization for Powers of Attorney in Abu Dhabi
In the Emirate of Abu Dhabi, POAs are e-notarized by the Abu Dhabi Judicial Department, or ADJD. It is important to remember that this jurisdiction only accepts requests for e-notarization from people who have a valid Emirates ID.
Using a web application like Cisco WebEx, the notarization can be done remotely. The principal/signatortory of the Power of Attorney participates in a video conference with the Notary Public officer at the ADJD as part of this procedure. The principal’s identification and the authority to be granted will be confirmed during the call.
You will receive your notarized Abu Dhabi power of attorney shortly after.
E-Notarization for Powers of Attorney at Dubai Courts Notary Public
The procedure used in Abu Dhabi is comparable to the remote notarization procedure in Dubai. Typically, BOTIM is used to verify the principal’s identity and the authority to assign powers.
